Foreign Nationals Unlawfully Present After Previous Immigration Violations
An individual is inadmissible if he or she:
- Has been unlawfully present in the U.S. for an aggregate period of more than one year; or
- Has been ordered removed under the expedited removal provisions of INA §235 or the removal hearing provisions of INA §240.
